RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT

This is an important agreement. By signing it, you are giving up certain rights. PLEASE READ IT CAREFULLY BEFORE SIGNING.

In consideration for being permitted to participate in skydiving activities including, but not limited to, parachute jumping, tandem jumping, accelerated free fall instruction, demonstration jumps, water jumps, ground transportation, flying or landing in an aircraft and/or any related activities (hereinafter collectively referred to as the "Activities Covered by this Release") conducted by Skydive Dubai LLC ("Skydive Dubai") and/or any of its affiliates, I confirm that I am at least eighteen (18) years of age and hereby agree as follows:

1. RELEASE OF LIABILITY I hereby fully release and discharge Skydive Dubai, the United States Parachute Association, their subcontractors, service providers, affiliates, designees and their instructors, jumpmasters, pilots, riggers, drivers, officers, directors, agents, employees, members, volunteers, aircraft owners and manufacturers, vehicle owners, landowners, tenants, sponsors and any other persons or entities connected with the Activities Covered by this Release (collectively, the "Releasees"), from any and all liability, claims, demands, causes of action, damages, losses, injuries, property damage, or death arising from or related to my participation in the Activities Covered by this Release, whether caused by negligence or otherwise, to the extent permitted by applicable law. Nothing in this Release excludes or limits any liability that cannot lawfully be excluded or limited under the laws of the United Arab Emirates.
2. WAIVER OF RIGHTS I understand that by signing this Release I am voluntarily giving up substantial legal rights, including the right to sue, and I do so freely and knowingly.
3. WAIVER OF CONTRACT DEFENCES I acknowledge that this Release is a legally binding contract and expressly waives any claims against the Releasees, including claims arising from their negligence, to the fullest extent permitted by law.
4. ASSUMPTION OF RISK I understand that skydiving is an inherently dangerous activity involving risks that may result in serious injury, permanent disability, property damage, or death. These risks include, but are not limited to, equipment malfunction, improper packing, aircraft incidents, adverse weather conditions, human error, inadequate supervision, hard landings, collisions, and unforeseen circumstances. I voluntarily and knowingly assume all risks associated with the Activities Covered by this Release.
5. AGREEMENT NOT TO SUE I agree never to institute any lawsuit, claim, demand, or legal proceeding against the Releasees arising out of or related to the Activities Covered by this Release. I further agree that my heirs, executors, administrators, personal representatives, and anyone acting on my behalf shall not institute or assist in any such action. Should any claim be brought contrary to this provision, I agree that the Releasees shall be entitled to recover legal fees and costs incurred in defending such claim.
6. INDEMNITY AGAINST THIRD-PARTY CLAIMS I agree to indemnify, defend, and hold harmless the Releasees from and against any and all claims, demands, damages, liabilities, losses, costs, and expenses, including legal fees, brought by any third party arising directly or indirectly from my participation in the Activities Covered by this Release.
7. VALIDITY OF AGREEMENT I understand that this Release may be relied upon and presented as a complete defense to any legal action brought by me or on my behalf arising from the Activities Covered by this Release.
8. APPLICABLE LAW / WAIVER OF TRIAL This release shall be subject to the laws of Dubai and the applicable federal laws of the United Arab Emirates (the "Laws") and the Laws shall apply to issues involving the construction, interpretation, and validity of the release and that the Laws shall govern any dispute arising from or related to this release or the activities covered by this release. Should this release be violated and suit be brought against any of the Releasees. The headings used throughout this release are for convenience only and have no significance in the interpretation of the body of release.
9. CONTINUATION OF OBLIGATIONS The provisions of this Release shall remain binding upon me, my heirs, executors, administrators, personal representatives, successors, and assigns and shall survive my participation in the Activities Covered by this Release.
10. MEDICAL FITNESS I declare and confirm that:
    • I understand that skydiving is an inherently hazardous activity that carries a risk of serious injury, death, and the aggravation of existing medical conditions.
    • I am physically and mentally fit to participate in the Activities Covered by this Release and do not suffer from any medical condition, injury, illness, disability, impairment, or psychological condition that may affect my ability to participate safely.
    • I am not awaiting the results of any medical tests or investigations, am not under medical review for any condition that may affect my ability to participate safely, and have not undergone any recent medical procedure or treatment that may compromise my participation.
    • I am not under the influence of alcohol, narcotics, controlled substances, or any medication that may impair my judgment, awareness, or physical performance. I have not consumed alcohol within the preceding twelve (12) hours and have not participated in scuba diving within the preceding twenty-four (24) hours. I acknowledge and agree that Skydive Dubai personnel may, at their sole discretion, assess my physical and mental condition, sobriety, fitness to participate, and compliance with safety instructions and operational requirements. I understand that if Skydive Dubai staff determine that I may be unfit to participate, impaired, unable or unwilling to comply with instructions, or that my participation may present a safety risk to myself or others, I may be denied participation or removed from activities without refund or compensation.
    • I understand that a previous shoulder dislocation may increase the risk of further injury during skydiving. I agree to disclose any history of partial or complete shoulder dislocation to Skydive Dubai and acknowledge that participation remains at my own risk.
    • I understand that Skydive Dubai, its instructors, staff, and representatives do not provide medical advice and are entitled to rely upon the information and declarations provided by me.
    • It is my sole responsibility to seek advice from a suitably qualified medical practitioner prior to participating in any skydiving activity if I have any doubt regarding my medical fitness.
    • I understand that any medical condition may be worsened by skydiving and may increase my risk of injury or death.
    • I agree to immediately inform Skydive Dubai of any injury, illness, medical condition, treatment, medication, or change in my health that may affect my ability to participate safely.
    • I accept full responsibility for my decision to participate in the Activities Covered by this Release.
    • I confirm that all information provided by me is true, accurate, and complete to the best of my knowledge.
    • If I am unsure about any medical condition, symptom, treatment, medication, or terminology contained within this Release, I will seek qualified medical advice before participating.
    • I understand that Skydive Dubai reserves the right to refuse participation to any person whom it reasonably believes may be medically unfit to safely participate in the Activities Covered by this Release.
11. RULES AND CONDITIONS I agree to comply with all rules, procedures, instructions, and conditions established by Skydive Dubai and acknowledge that they may be amended at any time without prior notice.
12. TRAINING I understand that prior to participating in tandem skydiving, I will receive a safety briefing and instructions relating to my tandem skydive. I acknowledge that it is my responsibility to pay attention to, understand, and follow all instructions provided. By voluntarily participating in tandem skydiving activity, I confirm that I have received and understood the briefing and accept full responsibility for complying with all safety instructions.
13. PHOTO & VIDEO RELEASE For valuable consideration received, I hereby grant Skydive Dubai and its legal representatives and assigns the irrevocable and unrestricted right to use and publish photographs and video images of me, or in which I may be included, for editorial, trade, advertising, and any other purpose and in any manner, medium, and jurisdiction, to alter the same without restriction and to copyright the same. This includes any and all uses that Skydive Dubai deems necessary or desirable.

    I agree that any images purchased by me are for personal use only and may not be used for commercial purposes without prior written authorization from Skydive Dubai. I hereby release Skydive Dubai from all claims and liability relating to any photographs or video images of me. I further agree that I will not use the logos or trademarks of Skydive Dubai or its affiliates in any photograph or video not produced or authorized by Skydive Dubai. While Skydive Dubai's camera flyers are highly trained and utilize industry-standard equipment, I acknowledge that photo and video services are subject to technical limitations and unforeseen equipment malfunctions beyond the control of Skydive Dubai. In the event that photographs and/or video footage are unavailable, incomplete, corrupted, lost, or otherwise unusable due to equipment malfunction, technical failure, human error, environmental conditions, or any other circumstance, Skydive Dubai's liability shall be limited solely to a refund of the amount paid for the photo and video package, currently AED 300. Any such incident will be reviewed by Skydive Dubai management, whose decision shall be final and binding. No further compensation, damages, or claims of any kind shall be payable or recoverable in connection with the failure to provide photo and/or video content.

14. THIRD-PARTY LIABILITY I acknowledge and agree that Skydive Dubai shall not be liable or financially responsible for any loss, damage, injury, claim, liability, or expense suffered by any third party arising from or related to my participation in the Activities Covered by this Release.
15. SAFETY RULES I acknowledge that I have read, understood, and agree to comply with all applicable safety and operational procedures, including the Skydive Dubai safety briefing, as amended from time to time. I understand that failure to comply with any safety requirement may result in the suspension or termination of my participation privileges.
16. ENTIRE AGREEMENT I acknowledge that this Release constitutes the entire agreement between myself and the Releasees relating to the Activities Covered by this Release and supersedes any prior agreements or understandings.
17. INSURANCE AVAILABILITY Skydive Dubai provides personal accident insurance coverage for tandem skydiving participants through a third-party insurance provider. Coverage may include accidental death, permanent total disablement, permanent partial disablement, repatriation, and emergency medical expenses, subject to the terms, conditions, exclusions, and limitations of the insurance policy. Any insurance coverage is provided solely by the insurance provider and constitutes a direct contract between the participant and the insurer. Skydive Dubai does not underwrite or administer the policy and accepts no liability whatsoever in relation to any claim, coverage decision, payment, or denial made by the insurance provider.
18. EMERGENCY MEDICAL TREATMENT I authorize Skydive Dubai and its representatives, in the event of an injury or medical emergency arising during or following my participation in the Activities Covered by this Release, to arrange, administer, or obtain such first aid, medical treatment, ambulance transport, or hospitalisation as they consider necessary in good faith, at my own cost, and I release the Releasees from any liability arising out of decisions made in connection with such emergency care.
19. WEATHER, OPERATIONAL DELAY, AND CANCELLATION I understand that skydiving operations depend on weather, aircraft availability, and other factors outside Skydive Dubai's control, and that my scheduled tandem jump may be delayed, rescheduled, or cancelled at Skydive Dubai's discretion for safety reasons. Skydive Dubai shall have no liability for any loss, expense, or inconvenience (including travel, accommodation, or opportunity costs) arising from any such delay, rescheduling, or cancellation. Any refund or credit shall be governed solely by Skydive Dubai's cancellation and refund policy in effect at the relevant time.
20. PASSENGER WEIGHT AND BMI LIMITS I confirm that my height and weight fall within the limits communicated to me by Skydive Dubai for tandem skydiving, and I acknowledge that Skydive Dubai may refuse or restrict my participation as a tandem passenger where such limits are exceeded, for the safety of myself, the tandem instructor, and others.

    I confirm that my weight and Body Mass Index (BMI) fall within the tandem skydiving limits established by Skydive Dubai. I understand that the applicable limits are:

    Female Passengers: Maximum weight of 90 kg and maximum BMI of 27.5.
    Male Passengers: Maximum weight of 100 kg and maximum BMI of 30.0.

    I acknowledge that Skydive Dubai may verify my weight and calculate my BMI prior to participation and may refuse, restrict, or cancel my participation as a tandem passenger if I exceed these limits, or if Skydive Dubai determines that my participation may present a safety risk to myself, the tandem instructor, or others.

21. PERSONAL DATA AND PRIVACY

    We process the personal data, including the health information you have disclosed, to (a) perform our service; (b) ensure safety and respond to medical emergencies; and (c) other relevant purposes. We may disclose this data to other parties. Furthermore, your specific consent is hereby acknowledged upon selecting the corresponding checkbox below:

    I consent to receiving marketing communications, news, offers, events, and customer research and satisfaction surveys relating to Skydive Dubai and its affiliates by email, WhatsApp, telephone, applications and SMS.
    I consent to Skydive Dubai using photographs and video in its marketing and social media.

    You can withdraw your consent at any time, free of charge, by using the unsubscribe link in any message we send you or by notifying us in writing. Our full privacy notice, including your rights of access, correction, erasure, restriction, portability and objection, is available on our website.

22. SEVERABILITY

    If any provision of this Release is held invalid or unenforceable by a court or arbitral tribunal of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions of this Release shall remain in full force and effect.
